Existing Conditions That Can Affect a Basement Apartment Permit

An existing finished basement is not automatically suitable for conversion into a legal basement apartment. The existing construction has to be reviewed against the requirements that apply to the proposed secondary suite.

In practice, some of the most important constraints are often existing conditions rather than the proposed room layout. Low beams or ductwork can affect usable headroom, existing stairs may not provide suitable geometry, windows may not satisfy required conditions, and previous structural or plumbing work may not have been permitted or documented.

A proposed separate entrance can also introduce additional issues involving foundation openings, structural support, exterior stairs, drainage, grading, guards, setbacks, and zoning. These conditions should be identified before the final layout is developed because correcting one issue can affect another part of the design.
